Naturalist Studies maintains this site, any courses offered, and other linked and related sites are for the use of its customers, vendors, students, and other users. Use of this site and purchase of any products indicates acceptance of these “Terms of Use."
Copyright
Naturalist Studies provides various materials, information, quizzes, tests, questions, articles, news and other information on this and related sites and in courses offered through this site. These materials are the property of Naturalist Studies, and the user may also receive additional materials that are copyrighted property of third parties. Users are granted a non-transferable and non-exclusive right to use course content provided they keep all materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal, modify, or distribute the materials, or store in a retrieval system, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in, or otherwise transfer any right in the course content. Any breach of these Terms of Use or unauthorized use of any materials that violate copyright, trademark, and other laws will automatically terminate the user’s authorized use of the site and may also result in legal action against the user.
Trademarks
Naturalist Studies trademarks, logos and course, program, product, and service names are trademarks of Naturalist Studies and are not authorized for display or use in any manner by the user or any third party without prior written permission.
Enrolment Fee
Full payment for courses is required for enrollment unless otherwise stated (e.g. subscription services or monthly payment plans) and prices shown are in U.S. dollars. All sales are final and non-refundable.
Course Access & Cancellation
Courses for outright purchase without a specified duration do not expire and are available in perpetuity. Subscription courses and courses with a specified duration will be accessible only for the time-period that the user is enrolled, and upon either termination of the subscription or course completion the user will no longer have access to the course or any of its materials. Naturalist Studies, at its sole discretion and without prior notice, may also terminate the user’s registered account (or any part thereof) or use of the site, and remove and discard any content within the site, for any reason without limitation, if Naturalist Studies believes that the user may have violated Terms of Use. Naturalist Studies may also in its sole discretion and at any time, discontinue providing the site, or any part thereof, with or without notice and reserves the right to cancel or remove courses or other content at any time. Termination, suspension, or cancellation of this agreement or the user’s access rights will automatically end all rights granted to the user and will not affect any right or relief to which Naturalist Studies may be entitled in law or in equity.
Third Party Sites
Links to external websites are provided solely as a convenience to the user. Naturalist Studies has not reviewed all of these external websites, does not control and is not responsible for any of these sites or their content. Accessing any of the external websites linked to this site is done so entirely at the user’s own risk.
No Warranty
Naturalist Studies makes no guarantees about the courses, programs or other products or services on this site and the results that user may have from purchasing them. The user agrees that any statements made by Naturalist Studies regarding potential outcomes are opinions and are not binding, and testimonials from previous users are not to be relied upon to predict future results, which will be dependent on many factors including but not limited to level of personal responsibility, commitment, and abilities, in addition to other factors that are not able to be anticipated by the user or Naturalist Studies. The materials available on this site are provided “as is” without any warranties of any kind including merchantability, fitness for a particular purpose, or non-infringement of intellectual property. Naturalist Studies may make changes to the materials at this site, or to the services and prices described in them, at any time without notice. Additionally, the materials on this site may be out of date, and Naturalist Studies makes no commitment to update the materials and does not warrant the accuracy or completeness of the materials.
No Professional or Medical Advice
At no time should any of Naturalist Studies courses, programs or other products or services be considered a substitute for professional medical or mental health services, nor should they be construed as professional therapy. They are not intended to treat, diagnose, cure, or prevent any disease. If at any time the user needs medical, and/or psychological treatment, it is the user’s responsibility to seek it out.
Limitation of Liability
Under no circumstances will Naturalist Studies, its owner, employees, agents, affiliates and co-branders, suppliers, or third partners, and other users mentioned at this site be liable for any damages whatsoever arising out of the use, inability to use, or the results of the use of this site, or any websites linked to this site, or the materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages (including, without limitation, those resulting from interruption of services or inaccurate information). Under no circumstances will Naturalist Studies and its owner, employees, agents, affiliates and co-branders, suppliers, or third partners, and other users, be liable for any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of content submitted, posted, transmitted or made available through the site by the user or their use of the site, connection to the site, or violation of the Terms of Use, or the user’s violation of any rights of any third party.
Non-Disparagement
Client agrees, during and after purchase of Products, to refrain from making any statements, whether oral or in writing, that negatively impact Company’s program, business, services, products, or reputation. In addition, Company agrees to refrain from making any statements, whether oral or in writing, that negatively impact Client or Client’s business.
Applicable Law
All legal matters will be governed in the United States by the state of Texas and any disputes that arise shall be brought in Travis County. Failure to enforce strict performance of the Terms of Use of Use shall not be construed as a waiver of any provision or right. Naturalist Studies may assign its rights and duties under the Terms of Use without notice to any party at any time.
Whole Agreement
This Agreement constitutes the entire agreement between the user and Naturalist Studies. This Agreement supersedes and cancels all prior or contemporaneous discussions, writings, negotiations, and agreements.
Modification Waiver
The Terms of Use agreement cannot be modified, supplemented, or amended unless agreed to in writing by all parties. To make the waiver binding, the party making the waiver must execute it in writing. The waiver of a term in this agreement shall not be considered a waiver of any other terms of this agreement and shall not be considered a continuing waiver. The modification or waiver of one term of this agreement does not affect any other term in the agreement, regardless of its similarity.
Severability
If any term in this Agreement is found to be void or voidable, the remaining terms of the agreement are unaffected, and deemed to remain in full force and effect, including those terms that are similar.
Effective Date and Updates
The Terms of Use are effective as of July 1st, 2022 and are subject to change without notice by Naturalist Studies at any time. Continued use of this site after such changes constitutes the user’s agreement to such changes.
Privacy Statement
What information do we collect, and what do we do with it?
When you enroll as a student (“learner”) in one of our courses, as a program participant, or as a subscriber on our site, as part of the enrolling process, we collect the personal information you give us, such as your name and email address which is stored on a secure server behind a firewall.
For marketing purposes, we may send you emails about our site and related course(s), registration, course content, your course progress and announcements about newly released podcasts, articles, and other relevant updates. We may also use your email to inform you about any changes to a course, survey you about your usage, or collect your opinion.
How do you get my consent?
When you provide us with personal information to become a learner on our site, make a purchase, or participate in the course, you imply that you consent to our collecting it and using it for that specific reason only.
If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent or provide you with an opportunity to say no.
How do I withdraw my consent?
If, after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at any time, by contacting us at [email protected].
Disclosure
We may disclose your personal information if we are required by law to do so.
Payment:
If you make a purchase on our site, we use a third-party payment processor (Stripe), but you also have the option to use a digital wallet (Paypal, Apple Pay, Google Pay). Payments are encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our site and related courses and its service providers.
Third-Party Services
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies with respect to the information we are required to provide to them for your purchase-related transactions.

Once you leave our course website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links on our course site, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.
